نصت المادة (1) من اللائحة المنظمة للاجراءات التي تتبع عند المطالبة بحقوق خاصة على أنه "مع مراعاة ما تضمنه أحكام الأمر الملكي الكريم رقم (23512) وتاريخ 25-11-1380هـ بخصوص نظرة قضايا المحاكم الشرعية فيما يقدم لهم من الدعاوى التي لاتحتاج إلى تحقيق يتعلق بالحق العام وذلك دون الرجوع للإمارات أو الشرطة ، يجوز لمن يدعي بحق خاص مالي له قبل غيره أن يتقدم لإدارة الحقوق المدنية باستدعاء يتضمن المطالبة بما يدعيه . Article (1) of the regulations organizing the procedures that should be followed upon claiming for private right set forth “While observing the terms of the Noble Royal Decree No(23512), dated 25/11/1380H regarding the lawsuits of the legal court with respect of what is filed to them of proceeding not requiring investigations relevant to the public right without referring to the emirates or the police that anyone who claims for a private financial right with others may file an application to the civil rights department including the claim with what he/she is claiming for ”.
وهذا النص يعطي الخيار لصاحب الشأن في حالة المطالبة حق مالي خاص لايحتاج إلى تحقيق يتعلق بالحق العام في أن يلجأ إلى إدارات الحقوق المدنية للمطالبة بما يدعيه ، إضافة فإنه بمقتضى هذا النص لايجوز لإدارة الحقوق المدنية أن تطلب منه اللجوء مسبقاً إلى السلطة القضائية المختصة . This event of claiming for a private right not requiring investigations related to the public right, shall have the right to resort to the civil rights department to claim for this term, the civil right departments are not entitled to request him to resort to the judiciary authority in advance.

سلطات إدارة الحقوق المدنية: Authorities of the Private Rights Department
 الاستدعاء والضبط . Summon and arrest. 
 الإحالة إلى الجهات المختصة . Referral to competent authorities. 
 منح المهل وتقديم الكفالات . Notices & bails award. 
 قواعد التصرف في حالة الإعسار . Rules of disposition in insolvencies. 
عند التقدم بالمطالبة بحق مالي خاص أمام إدارة الحقوق المختصة ، فإن هذه الإدارة تتمتع بالسلطات التالية : Upon filing a proceeding with a private financial right before the private rights department having the jurisdiction, this department shall have the following authorities:
أولاً : سلطة الاستدعاء والضبط : First: Summon & Arrest Authority
تعطي المادة الخامسة من اللائحة لإدارة الحقوق المدنية المختصة الحق في استدعاء المدعى عليه وسؤاله ومواجهته بادعاء المدعي وبالمستندات التي قدمها . كما يكون لها الأمر بضبط المدعى عليه ، وإحضاره ، إن كان الحق المدعى به ناشئاً عن جريمة تستوجب ضبطه وسجنه . Article five of the regulations gives the private rights department having the jurisdiction the right to summon the defendant, interrogating him, confront him with the plaintiff claim and with the documents he presented. The shall have right to arrest the defendant and bring him if the claimed right arises from a crime requiring arresting and jailing him.
كما يكون لها – طبقاً لأحكام المادة السادسة من اللائحة – الحق في الضبط والسجن إذا تخلف المدعى عليه عن الحضور بعد استدعائه وذلك في حالتين : As per the terms of the sixth Article of the regulations, they shall be entitled to arrest or jailing if the defendant fails to present after summoning him in case of:
1. أن يكون المدعي قدم سنداً تنفيذياً ، حكماً أو قراراً قضائياً جائز التنفيذ ، أو أمر من جهة ذات ولاية يتضمن ثبوت الحق المدعى به في ذمة المدعى عليه وحلول موعد استحقاقه . The plaintiff presents an executive document or an operational judgment or decision or an order from a department having the evidence of the claimed right within the custody of the defendant and it is payable. 1.

2. أن يكون المدعي قد قدم مستندات أو أوراق مكتوبة تحمل توقيع أو بصمة المدعى عليه أو وكيله الشرعي ظاهر منها ثبوت الحق المدعى به وحلول موعد استحقاقه . فإن حضر المدعى عليه بعد استدعائه أو تم إحضاره ، ولم ينازع في الحق المدعى به يكلف بالوفاء فوراً ، حتى وإن لم يكن بيد الدائن سند تنفيذي ، وإلاسجن إذا لم يقبل المدعي إمهاله . If the plaintiff presents written papers or other documents bearing the signature or thumb print of the defendant or his attorney-in-fact showing the conformation of the claimed right and it is payable if the defendant presents after summoning him or being brought and does not show any dispute about the claimed right, he shall be ordered to pay it at once even if the creditor does not have an operational document, otherwise, he shall be jailed if the plaintiff does not accept to give him a notice.
مع ملاحظة أنه ليس بإمكان المدعى عليه المنازعة فيما سبق البت فيه بحكم أو قرار اكتسب الصفة القطعية أو المشمولة بالنفاذ المعجل أو فيما صدرت بشأنه أوامر عليا واجبة التنفيذ . Taking into account that the defendant can not dispute in what was previously judged by a judgment or a decision which acquired the clear cut property or that including the immediate implementation or regarding what has been higher compulsory orders have been decreed.
ثانياً: سلطة الإحالة إلى الجهة المختصة: Second: The Authorities of referral to the entity having the jurisdiction:
وفقاً لأحكام المادة السابعة من اللائحة ، فإنه إذا لم يقدم المعي المستندات السابقة وتخلف المدعى عليه عن الضحور بعد استدعائه يحال المدعى إلى الجهة ذات الاختصاص بالنظر والحكم في دعواه . As per the terms of Article seven of the regulations, if the plaintiff does not present the above-mentioned document, and the defendant fails to present after summoning him, the plaintiff shall be referred to the authority having jurisdiction to consider and judge his proceeding.
ثالثاً: منح المهل والكفالات والسجن: Third: Awarding notices:
أعطت اللائحة لمدير إدارة الحقوق لمدنية الحق في إمهال المدين بالشروط الآتية: The regulations have given the manager of the Private Rights Department to give a notice to the debtor with the following conditions:
1. ألا يكون الدين تجارياً . The debt should not be commercial.
2. ألا تزيد المهلة عن سبعة أيام . The notice should not exceed seven days.
3. ان يكون ظاهر حال المدين يرجح أنه قادر على الوفاء بالدين . The debtor obvious condition id more likely to show that he can fulfill his debt.
4. أن يكون له محل إقامة ثابت ومعروف بالمملكة . He shall have a fixed and known address in the kingdom.

رابعاً: التصرف بحالة الإعسار: Fourth: Disposition of the insolvency case:
يجب التصرف بحالة الإعسار حسب اللوائح المنظمة لذلك . The insolvency case should be disposed as per the regulations organizing the same.
ملاحظات هامة حول نظام الحبس في الديون : Remarks about the jailing code in debts:
يمكن إبراز الملاحظات الآتية : The following remarks can be highlighted:
1. إجازة الحبس بدون سند تنفيذي . Allowing jailing without an executive order.
2. عدم تحديد مدة الحبس . Non-determination of the jailing term.
 لم تنص اللائحة على حد أقصى لمدة الحبس . The regulations have not set forth a maximum term for jailing.

3. إطالة الإجراءات Procedures elongation 3.
 حتى لو ادعى المدين الإعسار ، فإن هذا لايمنع من سجنه . Even if the debtor claims insolvency, this shall not prevent the authorities from jailing him. 
إجمالاً يمكن الرجوع إلى القوانين والأنظمة الخاصة بالحجز على الأموال والممتلكات وتنفيذ الأحكام الخاصة بالوفاء بالدين. Overall, one can refer to laws and acts pertaining to sequestration on money & properties and the and the implementation of judgments released for the fulfillment of debts.
هنا يأتي دور الإدارة القانونية بالمؤسسة التي تتولى متابعة الاجراءات القانونية الخاصة بتحصيل الديون على ضوء الأنظمة المرعية في المملكة في هذا الشأن . Here, the Legal Department in the institution shall assume the follow-up of the legal procedures regarding debts fulfillment in the light of the in-force acts in this regard in the Kingdom.
